John McClean 76 abused the boys between and while he worked for Terenure College. He left the school in after certain allegations were made and took up a role coaching rugby with UCD. Passsing sentence today, Judge Pauline Codd imposed an effective sentence of 11 years imprisonment with the final three years suspended. He also worked as a rugby coach in the school. McClean assaulted several of the victims under the guise of fitting them for costumes for plays he produced in the school.
He was removed from his role with the school plays in after certain allegations of abuse were made against him. Many of the subsequent indecent assaults committed by McClean occurred in this office when he brought boys there after they had got into trouble in class.
Dublin Circuit Criminal Court heard that some victims believed they were either not selected for or dropped from the school rugby team as punishment for challenging him over his sexual abuse of them. Inspector Miley said that in the father of one of the victims informed Father Robert Kelly, the then Provincial of the Carmelite Order in Ireland, about the allegation his son had made against McClean.
He said Fr Kelly had a number of meetings over the summer break with McClean during which it was made clear McClean would not be returning to Terenure College. He groomed the boys for sexual exploitation. He had money at a time when people were struggling, and spent this on cars, which had an impression on the boys.
He used copious amounts of alcohol to disarm his victims. He gave them money initially as a gift, but then this turned into a debt that had to be paid back. The abuse was similar for most of the boys. Each victim had suffered devastating psychological consequences. The six victim impact statements were harrowing. The court heard one of the boys was abused on the morning he sat his English exam in the Inter Cert. However, for indecent assault offences before , there are very strict sentencing guidelines, with the maximum sentence being two years in prison.
Aggravating factors included the nature of the abuse; effect on the victims; and intensity of the abuse. He provided them with fast food, alcohol, gifts, and money.
He brought them for trips in his car. This was all manipulative grooming for the abuse which was to follow. Another factor was the group participation of the boys in creating a perception that what was happening was the norm.
The use of paraphernalia for restraint and the use of alcohol to disarm his victims and facilitate the commission of an offence were other factors. He said the suffering of each of the 10 victims should be recognised by the court.
The 10 month sentences are to run consecutively. Myself, Colin, Jason, and Barry left. There is no apology that will ever take away the hurt, the pain, the devastation.
